In consideration of my entry being accepted and my being permitted to participate in this event, I, the participant, intending to be legally bound, hereby waive, release, and forever discharge the Event Director, RunSignup.com, South Monterey County Joint Union High School District, King City High School, and each of their respective officers, board members, administrators, employees, coaches, agents, representatives, volunteers, sponsors, affiliates, and any other individuals or organizations assisting with or associated with the event (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, liabilities, losses, or expenses arising out of or related to my participation in the event, to the fullest extent permitted by law.
This release applies to injuries, illnesses, death, property damage, or other losses that may occur before, during, or after the event and that arise from or relate to my participation in the event, including risks inherent in running and road-race activities. I understand and intend that this release shall be binding upon me and, where legally applicable, my heirs, executors, administrators, representatives, and assigns.
I specifically acknowledge and agree that South Monterey County Joint Union High School District and King City High School shall not be held responsible or liable for injuries, illnesses, death, property damage, losses, accidents, or other claims arising from or relating to my participation in this event, to the fullest extent permitted by applicable law. I agree not to bring or maintain any claim, lawsuit, demand, or other legal proceeding against the District, King City High School, or their officers, board members, administrators, employees, coaches, agents, representatives, or volunteers for matters covered by this release.
I understand that participating in a road race, run, walk, or related athletic event is a potentially hazardous activity. I should not participate unless I am medically able and properly prepared. I knowingly and voluntarily assume the risks associated with participating in this event, including, but not limited to, falls; contact or collisions with other participants, spectators, vehicles, animals, or objects; weather conditions; heat; cold; uneven or hazardous surfaces; traffic; course conditions; physical exertion; dehydration; and other risks ordinarily associated with running, walking, and outdoor athletic events.
I acknowledge that these risks are known and understood by me, and I voluntarily assume responsibility for them. I agree to follow the instructions and decisions of race officials concerning my ability to safely participate in or complete the event. I certify that I am physically capable of participating in the event and have adequately prepared for the activity.
In the event of illness, injury, accident, or medical emergency arising during the event, I authorize the Event Director, event personnel, volunteers, or emergency responders to obtain medical treatment deemed reasonably necessary for my immediate care. I understand and agree that I am responsible for any costs associated with medical transportation, medications, treatment, hospitalization, or other medical services provided to me, except to the extent otherwise required by applicable law.
CDC AND COVID-19 SAFETY GUIDELINES
As it applies to my participation in this race, I agree to abide by the Centers for Disease Control and Prevention (CDC)recommendations and guidance regarding the prevention and spread of COVID-19 and other applicable communicable illnesses. I acknowledge that I have been provided access to the CDC’s current guidance at https://www.cdc.gov.
I further agree to abide by any applicable health, safety, distancing, sanitation, or other public-health guidelines or requirements issued by the CDC, the State of California, local public-health authorities, South Monterey County Joint Union High School District, King City High School, or the event organizers that may be in effect at the time of the event.
I understand that participation in a public event may involve potential exposure to communicable illnesses, including COVID-19. I voluntarily assume the risks associated with participating in the event and agree to follow reasonable health and safety instructions established for the protection of participants, volunteers, staff, spectators, and the community.
I grant permission to the Released Parties to use my name, image, likeness, voice, race results, photographs, video recordings, or other recordings made in connection with the event for legitimate event-related, educational, promotional, informational, or historical purposes without compensation to me, to the extent permitted by law.
I understand and agree that all entry fees are non-refundable unless otherwise expressly stated by the event organizers. The event organizers reserve the right to postpone, modify, relocate, shorten, or cancel the event because of circumstances beyond their reasonable control, including severe weather, natural disasters, emergencies, unsafe course conditions, governmental requirements, public-health emergencies, or other circumstances affecting participant or staff safety. I understand that no refund is guaranteed if the event is modified, postponed, or canceled under such circumstances. Bib numbers and event registrations are non-transferable unless expressly authorized by the Event Director.
By submitting this entry or signing below, I acknowledge that I have carefully read and understand this Release, Waiver of Liability, Assumption of Risk, and Indemnification Agreement. I understand that I am giving up substantial legal rights, including certain rights to bring claims or lawsuits against the Released Parties, including South Monterey County Joint Union High School District and King City High School. I acknowledge that I am signing or accepting this agreement freely and voluntarily.
