Greely High School Therapy Dog Polar Plunge Liability Waiver

In consideration of you accepting this entry, I, the participant, intending to be legally bound, do hereby waive and forever release any rights and claims for damages or injuries that I may have against the Event Director, Landowner, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any injuries to me or my personal property. This release includes all injuries and/or damages I or my child suffer before, during, or after the event. I recognize, intend, and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that participating in a polar plunge is a potentially hazardous activity. I should not enter and participate unless I or my child am medically able to do so. I assume all risks associated with participating in this event, including, but not limited to, falls, contact with other participants, the effects of weather, traffic, and beach conditions, and waive any claims which I might have based on any of those and other risks typically found in a polar plunge. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any event official relative to the ability to complete the event safely. I certify as a material condition to my being permitted to enter this race that my child and/or I are physically fit for the participation in this event and that a licensed Medical Doctor has verified my or my child's physical condition.

In the event of an illness, injury, or medical emergency arising during the event, I hereby authorize and give my consent to the Event Director to secure from any fire/rescue personnel, hospital, clinic, and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any medical services and treatment rendered to me, including but not limited to medical transport, medications, treatment, and hospitalization.

Further, I grant permission to all the foregoing to use my name, voice, and images of myself or my child in any photographs, motion pictures, results, publications, or any other print, videographic, or electronic recording of this event for legitimate purposes.

All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control, such as a natural disaster or emergency, or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and non-transferable.

1. Safety Requirements: Participants must strictly adhere to the following safety protocols. Failure to follow these
   rules will result in immediate removal from the event and premises:
   ● Participants will run in and out of the water. The Beach is shallow. Water will be chest-deep.
   You may dunk your head underwater. This polar plunge is not based on how long you can
   stay in the water. 
   ● Participants are encouraged to wear flip-flops, Crocs, or other water shoes.
   ● No pushing, shoving, dunking, drowning, diving, or roughhousing.
   ● All participants must stay within the marked beach and water boundaries.
   ● Prohibited clothing in the water: Sweatshirts, sweatpants, jeans, socks, shoes.
   ● Everyone must wear a bathing suit as the minimum required clothing. Nudity is prohibited.
   ● Park legally on the side of Goose Pond Road; Walk on the side of Glendale Road to the
   private beach. Car-pooling is encouraged.
   ● The location of this event is a private, family-owned beach. You are expected to pick up
   trash and respect both property, plants, and wildlife.
2. Event Inclusions:
   - Volunteer Public Safety Personnel (Fire & Rescue) on-site
   - 3 single-person changing tents
   - Fire extinguisher for the Solo Fire Pit
   - Prize awards for the top 2 teams of 4 people
   - Porta Potty
   - Free event bracelets 
   - Long-sleeve shirts for sale  - $20 each
   - Hot cocoa and coffee

3. Acknowledgment and Assumption of Risk:
I, the undersigned, and in consideration of my child, if applicable, am being permitted to participate in this polar plunge, and agree as follows:

● I understand and agree that my child or I will not push myself beyond my limits, will listen to the rules, and will acknowledge the safety hazards. These include, but are not limited to:
o Hypothermia is when the core body temperature drops below 95 F)
o Lacerations from normal natural body of water debris.
o Burns from a fire pit and hot beverages.

● I also understand and agree that such activity involves dangers of serious bodily injury, including permanent disability, paralysis, and death, and that these risks and dangers may be caused by my or my child’s own actions or inactions or the actions or inactions of others participating in the event or the conditions under which the event takes place.

● I fully accept and assume all such risks and dangers and all of the responsibility for losses, costs, and damages incurred as a result of my or my child's participation in this event. I also understand and acknowledge that while MSAD 51 has implemented safety measures, it is impossible to eliminate all risks associated with plunging in cold water.

Also, in consideration of me and or my child being permitted to participate in the event, I, for myself and my child, hereby covenant not to, and waive my right to, sue MSAD 51 and its respective administrators, directors, agents, officers, members, landowners, volunteers, employees, and other program participants (“Releasees”), from all liability, claims, demands, losses, or damages on my or my child account, or alleged to be caused in whole or in part by the acts or omissions of the Releasees, related in any way to the event, except those caused by the Releasees' negligence.

I have read this waiver, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional waiver of all liability to the greatest extent allowed by law and agree that if any portion of this waiver is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver, including the no-refund policy.
