PARTICIPANT WAIVER, RELEASE & EVENT POLICIES

Benefiting: A local charity to be announced

By registering for or participating in the Get Fit Yelm – Run Santa Run 5K (“Event”), I acknowledge that I have read, understood, and voluntarily agree to the following waiver, release, and event policies.

1. ASSUMPTION OF RISK
I understand that participation in a 5K run/walk involves inherent risks, including but not limited to slips, trips, falls, collisions with other participants, uneven or slippery surfaces, road and traffic hazards, weather conditions, cold temperatures, rain, physical exertion, dehydration, overexertion, illness, serious injury, permanent disability, and death.

I understand that these risks may arise from my own actions, the actions of other participants, event conditions, or circumstances beyond the control of the Event organizers.

I voluntarily choose to participate in the Event and knowingly assume all risks, both known and unknown, associated with my participation, to the fullest extent permitted by law.

2. RELEASE AND WAIVER OF LIABILITY
In consideration of being permitted to participate in the Event, I, on behalf of myself and my heirs, executors, administrators, personal representatives, and assigns, hereby release and hold harmless, to the fullest extent permitted by law, Elite Performance LLC, doing business as Get Fit Yelm, and its owners, officers, employees, contractors, agents, volunteers, event organizers, sponsors, participating organizations, and other representatives (collectively, the “Released Parties”) from claims, liabilities, damages, or demands arising out of or related to my participation in the Event, including claims arising from ordinary negligence, except to the extent such release is prohibited by applicable law.

This release does not apply to gross negligence, willful or wanton misconduct, or any other liability that cannot legally be waived.

I understand that this waiver is intended to be as broad and inclusive as permitted by Washington State law.

3. MEDICAL TREATMENT AND EMERGENCY AUTHORIZATION
I certify that I am physically capable of participating in the Event and that I have no known medical condition that would make participation unsafe, or that I have sought appropriate medical advice regarding my participation.

I authorize Event personnel to seek emergency medical assistance for me if deemed necessary. I understand that I am responsible for any medical expenses, treatment costs, ambulance fees, or other expenses incurred as a result of injury or illness during the Event.

I understand that the Event organizers are not responsible for providing medical insurance or paying medical expenses on my behalf.

4. INDEMNIFICATION
To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from third-party claims, liabilities, damages, and reasonable expenses arising from my negligent or wrongful acts or omissions in connection with my participation in the Event.

This provision does not require me to indemnify any party for liability to the extent prohibited by applicable law.

5. PHOTO, VIDEO, AND MEDIA RELEASE
I understand that photographs, video recordings, and other media may be captured during the Event.

I grant Elite Performance LLC, doing business as Get Fit Yelm, and its authorized representatives permission to photograph, record, and use my image, likeness, voice, and appearance for lawful promotional, marketing, advertising, and informational purposes without compensation.

Such use may include, but is not limited to, websites, social media platforms, paid advertisements, flyers, posters, email marketing, promotional materials, and future event marketing.

I understand that these materials may be published or distributed publicly and that I will not receive payment or royalties for their use.

I understand that this release does not authorize the use of my image in a manner that is unlawful or falsely implies my endorsement of a product or service.

6. MINORS AND PARENTAL/GUARDIAN CONSENT
Participants under the age of 18 must have this waiver completed and acknowledged by a parent or legal guardian before participating in the Event.

By signing on behalf of a minor, I represent that I am the minor's parent or legal guardian and have authority to provide consent on their behalf. I have read and understand this waiver and consent to the minor's participation.

I understand the risks associated with the Event and, to the fullest extent permitted by law, agree to the applicable assumption-of-risk, release, and indemnification provisions on behalf of myself and the minor.

I understand that I am responsible for supervising my minor child before, during, and after the Event, including before the official start and after the finish.

Children who are not registered participants must remain under the direct supervision of their parent or legal guardian at all times. The Event organizers are not responsible for supervising unregistered children.

Nothing in this section waives or releases any claim on behalf of a minor that cannot legally be waived under Washington State law.

7. EVENT CONDITIONS, WEATHER, AND CHANGES
I understand that the Event is an outdoor activity and may be affected by weather, road conditions, safety concerns, or other circumstances beyond the organizers' control.

The Event organizers reserve the right to modify the course, start time, schedule, event activities, or other arrangements as reasonably necessary for safety or operational reasons.

The Event organizers may delay, postpone, modify, or cancel the Event if conditions warrant such action.

I agree to follow all posted instructions, traffic controls, course markings, and directions from event staff and volunteers. I understand that failure to follow instructions may result in removal from the Event.

I understand that costumes and holiday attire are encouraged, but my clothing, accessories, and footwear must not create an unreasonable safety hazard or interfere with my ability to participate safely.

8. PERSONAL PROPERTY
I understand that I am responsible for my own belongings and personal property during the Event.

Elite Performance LLC, doing business as Get Fit Yelm, and the other Released Parties are not responsible for lost, stolen, or damaged personal property, except where liability cannot legally be excluded.

9. REGISTRATION FEES, REFUNDS, AND CHARITABLE PROCEEDS
I understand that registration fees for the Run Santa Run 5K are non-refundable and non-transferable, except where otherwise required by law or expressly stated by the Event organizers.

I understand that the Event is intended to support a local charitable organization, which will be announced by the organizers. Any representation regarding charitable proceeds refers to the net proceeds designated for donation after applicable Event expenses, unless otherwise expressly stated by the organizers.

I understand that the Event organizers may change, postpone, modify, or cancel the Event due to weather, safety concerns, or other circumstances beyond their reasonable control. Any refund or credit policy will be subject to applicable law and the registration terms communicated by the organizers.

10. PARTICIPANT CONDUCT AND EVENT RULES
I agree to conduct myself respectfully and safely throughout the Event and to follow all instructions provided by Event organizers, staff, volunteers, and public safety personnel.

I will not engage in behavior that endangers myself or others, disrupts the Event, or interferes with the safe participation of others.

I understand that the organizers reserve the right to remove any participant whose conduct creates a safety concern or violates Event rules, subject to applicable law.

11. ACKNOWLEDGMENT AND AGREEMENT
By signing or electronically acknowledging this waiver, I confirm that:

I have read and understood this Participant Waiver, Release & Event Policies document.
I understand that participation in the Event involves inherent risks.
I voluntarily assume those risks to the extent described in this waiver.
I understand that I am releasing certain legal claims to the fullest extent permitted by law.
I certify that the information I provide during registration is accurate.
If registering a minor, I confirm that I am the minor's parent or legal guardian and have authority to consent on their behalf.
I agree to follow all Event rules and instructions.
I understand that this waiver is a binding legal document and that I may wish to seek independent legal advice before agreeing to its terms.
