MEMPHIS YOUTH ATHLETICS
FALL 2026 CROSS COUNTRY EVENTS
PARTICIPATION WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, MEDICAL AUTHORIZATION, INDEMNIFICATION, AND MEDIA RELEASE

By checking the acknowledgment box during registration, you are electronically signing this Agreement and agreeing to all of the terms below. If the participant is under eighteen (18) years of age, this Agreement must be accepted by the participant's parent or legal guardian.

In consideration of being permitted to participate in any Memphis Youth Athletics ("MYA") Fall 2026 Cross Country event, including the Frank Horton Classic, regular season meets, championship meets, practices, warm-ups, course walks, and related activities (collectively, the "Events"), I acknowledge and agree as follows:

1. Assumption of Risk

I understand that participation in cross country running and related athletic activities involves inherent risks that cannot be eliminated regardless of the care taken by event organizers. These risks include, but are not limited to:

• Falls, slips, trips, and collisions;
• Contact with participants, coaches, officials, volunteers, spectators, or equipment;
• Uneven terrain, natural obstacles, road crossings, course conditions, and other environmental hazards;
• Weather conditions including heat, humidity, cold, rain, lightning, and other severe weather;
• Physical exertion, dehydration, heat illness, cardiac events, and other medical emergencies;
• Transportation to and from event locations; and
• Other risks inherent in youth athletic participation.

I knowingly and voluntarily assume all known and unknown risks associated with participation in the Events and accept full responsibility for my participation or, if applicable, my child's participation.

2. Participant Health Certification

I certify that I (or my child) am physically able to safely participate in the Events and have no known medical condition that would make participation unsafe.

I understand it is my responsibility to consult a licensed healthcare provider regarding any medical concerns before participating.

I agree to notify MYA immediately if I or my child becomes ill, injured, or otherwise unable to safely participate.

3. Release and Waiver of Liability

To the fullest extent permitted by the laws of the State of Tennessee, I voluntarily release, waive, discharge, and covenant not to sue:

• Memphis Youth Athletics ("MYA");
• The Frank Horton Classic;
• The Tennessee Secondary School Athletic Association (TSSAA), where applicable;
• Shelby Farms Park Conservancy;
• Shelby Farms Park;
• Any host school, host venue, or facility owner;
• Sponsors;
• Race officials;
• Volunteers;
• Directors;
• Officers;
• Employees;
• Independent contractors;
• Agents; and
• Their respective affiliates, successors, assigns, and representatives
  (collectively, the "Released Parties"),
• from any and all claims, demands, causes of action, damages, liabilities, losses, expenses, or costs arising out of or relating to participation in the Events, including claims arising from the ordinary negligence of any Released Party, except where prohibited by law or arising from gross negligence, reckless misconduct, or intentional misconduct.

4. Indemnification

To the fullest extent permitted by law, I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, demands, lawsuits, liabilities, judgments, damages, losses, costs, and reasonable attorneys' fees arising out of or relating to:

• My actions or omissions during the Events;
• My child's actions or omissions during the Events;
• My or my child's violation of event rules or instructions;
• Damage to persons or property caused by me or my child;
• Claims asserted by third parties arising out of my or my child's participation in the Events;
• or Claims brought on behalf of my child to the extent permitted under applicable law.

This indemnification obligation shall not apply to claims resulting solely from the gross negligence or willful misconduct of a Released Party.

5. Medical Authorization

In the event of an illness, injury, or medical emergency during the Events, I authorize MYA and its designated representatives to obtain emergency medical care reasonably deemed necessary for myself or my child.

I understand that reasonable efforts will be made to contact the emergency contact listed during registration.

I accept full financial responsibility for all medical expenses incurred, including emergency transportation, physician services, hospitalization, medications, and related treatment not covered by insurance.

6. Rules, Safety Policies, and Participant Conduct

I agree that I and/or my child will comply with all MYA rules, event procedures, safety policies, venue rules, and instructions provided by race officials, volunteers, and staff.

I understand that MYA reserves the right to suspend or remove any participant whose behavior is unsafe, unsportsmanlike, disruptive, abusive, or otherwise inconsistent with MYA policies, without refund where permitted by MYA policy.

7. Media Release

I grant MYA the unrestricted right to photograph, videotape, record, or otherwise capture my or my child's name, likeness, voice, image, and performance during the Events.

I authorize MYA to use these materials without compensation for educational, promotional, fundraising, historical, marketing, website, social media, broadcast, or other lawful organizational purposes.

8. Communicable Disease Acknowledgment

I understand that participation in athletic events may involve exposure to communicable illnesses, including COVID-19, influenza, RSV, and other infectious diseases.

I voluntarily assume the risks associated with exposure to communicicable illnesses.

I agree that I or my child will not participate if experiencing symptoms of a contagious illness, has been advised by a healthcare provider not to participate, or otherwise poses a health risk to others.

I agree to comply with any health or safety protocols implemented by MYA or the event venue.

9. Parent or Legal Guardian Acknowledgment

If the participant is under eighteen (18) years of age, I certify that I am the participant's parent or legal guardian and have the legal authority to execute this Agreement on the participant's behalf.

I acknowledge that I have carefully read this Agreement, understand its contents, have had the opportunity to ask questions, and voluntarily agree to all of its terms on behalf of myself and my child.

10. Severability and Governing Law

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This Agreement shall be governed by and interpreted under the laws of the State of Tennessee.

11. Electronic Acknowledgment and Agreement

By checking the acknowledgment box during registration and submitting my registration, I certify that:

• I have carefully read and fully understand this Participation Waiver, Release of Liability, Assumption of Risk, Medical Authorization, Indemnification, and Media Release.
• I understand that participation in cross country involves inherent risks and that I am voluntarily accepting those risks for myself or my child.
• I understand that I am giving up certain legal rights, including the right to bring certain claims against the Released Parties as described in this Agreement.
• If registering a participant under eighteen (18) years of age, I certify that I am the participant's parent or legal guardian and have the legal authority to enter into this Agreement on the participant's behalf.
• I acknowledge that checking the acknowledgment box and submitting this registration constitutes my electronic signature and has the same legal force and effect as my handwritten signature under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act), the Tennessee Uniform Electronic Transactions Act, and other applicable law.
• I voluntarily agree to all of the terms and conditions contained in this Agreement.
• I understand that this Agreement applies to all Memphis Youth Athletics Fall 2026 Cross Country Events for which the participant is registered during the Fall 2026 season unless superseded by a subsequent written agreement.
