PARTICIPANT ACKNOWLEDGMENT OF RISK, LIMITED RELEASE, AND EVENT AGREEMENT
New Year’s Day 2027 5K Run/Walk

In consideration of acceptance of my entry into the New Year’s Day 2027 5K Run/Walk (the “Event”), I acknowledge and agree to the following:
Participation and Acknowledgment of Risk
I understand that running or walking in this Event involves risks that may result in serious injury, illness, death, or property damage. These risks include falls; uneven or slippery surfaces; interaction with vehicles; contact with participants, strollers, volunteers, spectators, or objects; physical exertion; and weather conditions, including cold, ice, rain, and wind.
I understand that the course may not be completely closed to vehicular traffic or other members of the public. The presence of course marshals, volunteers, or law enforcement does not eliminate these risks.
I voluntarily choose to participate with an understanding of these risks. I am sufficiently prepared and physically able to participate safely. I will not start or continue if illness, injury, or another condition makes participation unsafe.
Safety and Event Rules
I agree to follow the designated course, posted rules, and instructions from race officials, volunteers, law enforcement, and emergency personnel. I understand that race officials may stop my participation for safety reasons or failure to follow Event rules.
If participating with a stroller, I will maintain control of it, allow adequate space around other participants, and follow all stroller requirements established by the Event.
Limited Release
To the extent permitted by Virginia law, I release Peninsula Track Club; York County, including its Parks and Recreation Department and McReynolds Athletic Complex; York High School; the York County School Board; Event organizers, officials, volunteers, and sponsors; and their respective officers, employees, and authorized agents from claims arising from my participation that may lawfully be released in advance.
Nothing in this agreement releases liability for negligence resulting in personal injury where such a release is prohibited by Virginia law, or for gross negligence, reckless conduct, intentional misconduct, or any other liability that cannot legally be waived.
Emergency Assistance
If I become injured or ill, I authorize Event personnel to request emergency medical assistance on my behalf. I understand that I am responsible for charges associated with medical care or transportation provided to me.
Event Changes, Cancellation, and Refunds
I understand that entry fees are non-refundable, except as required by law. The Race Director may delay, modify, shorten, relocate, or cancel the Event when reasonably necessary because of hazardous weather, unsafe course conditions, an emergency, government direction, or other circumstances beyond the organizers’ control.
If the Event is changed or canceled, no refund or credit will be provided except as required by law. I am responsible for my personal expenses, including travel and lodging.
Photography and Media Permission
I authorize Peninsula Track Club, York High School, York County Parks and Recreation, and their authorized representatives to use my name and photographs, video, or audio recordings of my participation for Event coverage, race results, and promotion of the Event or the participating organizations, without compensation.
Participants Under Age 18
A parent or legal guardian must complete this agreement for any participant under age 18.
As the minor’s parent or legal guardian, I consent to the minor’s participation, acknowledge the risks described above, and agree to the applicable Event rules and permissions. I understand that this agreement does not waive any rights of the minor that cannot legally be waived.
Acknowledgment and Signature
I have read and understand this agreement. I voluntarily accept its terms and understand that it includes an acknowledgment of risk and a limited release of claims to the extent permitted by law.
