Waubonsee Foundation Trail Run
Release of Liability and Indemnity
PARTICIPATION
I wish to participate in the Waubonsee Foundation Trail Run event at Waubonsee Community College (“College”) on May 30, 2026, which will include participating in the race (the “Activities”). This event benefits the Waubonsee Community College Foundation (“Foundation”) and is supported by other vendors (“Vendors”). I recognize and acknowledge that there is some degree of risk in the course of participating in these Activities, and that the College, the Foundation, and Vendors for this event cannot guarantee risk-free experiences to participants. Accordingly, I hereby voluntarily assume all risks related to my participation in the Activities, and will follow all recommended and appropriate safety precautions.
I further understand and acknowledge that the College takes photos and video of participants at College activities and on College property for advertising and promotional materials. By signing the waiver, I am giving permission to the College and Foundation to use my name, these photos, and video in College publications, advertisements, articles, and on the College website and social media outlets. All photos and video are the property of the College.
WARNING OF RISK
Participation in the Activities presents the risk of potential injury. All hazards and dangers cannot be foreseen. Depending on the particular activity, certain risks, dangers and injuries due to inclement weather, overexertion, improper technique, ignoring safety precautions, failing to follow instructions, slips and falls, horseplay, premises defects and other risks inherent to the Activities exist. Therefore, it is impossible for the College, Foundation, and Vendors to guarantee absolute safety.
Dependent upon a person’s physical condition, age and/or skill level, the risks of the Activities can range from minor injuries to major injuries, including death. Such injuries can include but are not limited to: (1) skin, bone, and joint injuries; (2) back and neck injuries; (3) heart attack, stroke, and circulatory problems; (4) muscle strain and other muscle injuries; and (5) head and mental injuries. I assert that I am physically fit and sufficiently trained for participation in the Activities and I have no restrictions from a medical doctor that would prevent my participation.
In the event of an illness, injury, or medical emergency arising during the event I hereby authorize and give my consent to the College, Foundation, and Vendors to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.
ACKNOWLEDGEMENT OF RULES
I agree to follow rules and guidelines of the Activities, and to abide all decisions of any race official relative to my ability to safely complete the Activities.
This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non-transferable.
WAIVER OF LIABILITY
I am an adult participant, or I am an adult authorized to sign on behalf of a minor participant, I hereby voluntarily agree to the fullest extent permitted by law:
1. To fully waive, release, forever discharge, and hold harmless the College, the Foundation, the Vendors, and their trustees, officers, administrators, employees, agents, representatives, volunteers, and all other associated persons from all claims, demands, causes of action, losses, liabilities, and damages connected with my participation, including and not limited to claims arising from injury, illness, communicable disease, and death.
2. To indemnify, defend and hold harmless the College, the Foundation, the Vendors, and their trustees, officers, administrators, employees, agents, representatives, volunteers, and all other associated persons from all third-party claims, demands, causes of action, losses, liabilities, and damages arising from my participation in the Activities, including and not limited to claims arising from injury, illness, communicable disease, and death.
3. To recognize that the College, the Foundation, the Vendors, their trustees, members, officers, administrators, employees, agents, representatives, volunteers, or any other associated persons are not responsible for any potential mistakes, oversights, actions, or inactions of any entity or vendor conducting a specific event or activity on behalf of the College.
IT IS MY INTENTION BY THIS RELEASE TO FULLY EXEMPT, RELIEVE AND INDEMNIFY THE COLLEGE, THE FOUNDATION, THE VENDORS, AND THEIR TRUSTEES, OFFICERS, AGENTS, SERVANTS, EMPLOYEES, INSTRUCTORS, ASSISTANTS, STUDENTS, AND VOLUNTEERS FROM AND AGAINST LIABILITY FOR PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITES.
I have read and fully understand the above important information, warning of risk, release of all claims, and understand the legal significance. I further understand that participation in the aforementioned Activities is an inherently dangerous activity, and agree that this release shall be construed in accordance with, and governed by, College policies and Illinois law.
