Waiver

(1) This waiver agreement (the “Waiver”) is being entered into by me (the “Registrant”) on behalf of myself and each athlete (whether myself or a minor) who I enter and register as a participant (each a “Participant”), and is taking part in a triathlon or multi-sport camp organized by the Bermuda Triathlon Association (the “BTA”) comprising a multi-sport camp over a number of days comprising swimming (in open water), cycling (on open roads) and running (on open roads) over varying distances (the “Camp”).  In registering for the Camp and paying the fee in respect of the Camp to the BTA, the BTA hereby grants membership to each Participant for the period of the Camp, and $10 of the participation fee shall be paid as the membership fee for the BTA for such period. 

(2) The Camp is being organized, run and sanctioned by the BTA and is an informal camp which will involve swimming in open water in the ocean, and running and cycling on open roads with no marshalls. In addition to directors, officers and employees of the BTA respectively, and the coaches (“Coaches”) who will be participating in delivering the Camp content, there may be one or more volunteers assisting to run the Camp (the BTA, its directors, officers, employees and agents, the Coaches and the volunteers and all other persons involved with organizing, running and putting on the Camp are collectively referred to herein as “Indemnified Persons” and each an “Indemnified Person”).      

(3) By registering for the Camp on www.racedayworld.com, the Registrant on behalf of each Participant understands and acknowledges that he/she is legally agreeing to the statements in the following paragraphs of this Waiver and that these statements are being accepted by the BTA and each other Indemnified Person in consideration for allowing the Participant to participate in the Camp; the Registrant on behalf of each Participant further understands and acknowledges that her/his statements are being relied upon by the Indemnified Parties.

(4) On behalf of each Participant, her/his executors, administrators, heirs, next of kin, successors and assigns, and anyone else who might sue on a Participant’s behalf, the Registrant HEREBY WAIVES, RELEASES and FOREVER DISCHARGES each Indemnified Person from any and all claims, causes of action, damages, losses (economic and non-economic), and liabilities of every kind (collectively "Claims"), for death, personal injury, or property damage, which may arise out of, result from, or relate to each Participant’s participation in the Camp. 

(5) The Registrant on behalf of each Participant acknowledges that the sports of triathlon, duathlon and other multi-sports are an extreme test of a person’s physical and mental limits and carry with them the potential for death, serious injury, and property damage, and acknowledges and agrees that it is her/his responsibility to determine whether each Participant he/she is registering is sufficiently fit and healthy enough to safely participate in the Camp based on the eligibility criteria. The Registrant on behalf of each Participant attests and certifies that each Participant is or will be sufficiently fit and physically trained to participate in the Camp. The Registrant on behalf of each Participant declares that she/he has no physical or medical condition which would endanger her/him or others if each Participant participates in the Camp, or would interfere with her/his ability to safely participate in the Camp. The Registrant on behalf of each Participant accepts responsibility for the condition and adequacy of her/his equipment and her/his conduct in connection with the Camp.  

(6) The Registrant on behalf of each Participant:

·         acknowledges and ASSUMES ALL OF THE RISKS and aspects of the Camp;

·         acknowledges that running, bicycling, swimming and other portions of the Camp are inherently dangerous;

·         understands that she/he will be participating in the Camp at her/his own risk;

·         understands that she/he is waiving and releasing her/his legal rights to sue for any injury or damages arising out of or resulting from each Participant’s participation in the Camp;

·         understands that any injury or damages incurred may be the result of negligence, omission or carelessness by an Indemnified Person.

(7) The Registrant on behalf of each Participant further covenants and agrees that no Participant shall sue or bring any legal action of any nature against any of the Indemnified Persons for any of the Claims that she/he has waived, released, or discharged in this Waiver. The Registrant on behalf of each Participant agrees to indemnify and hold harmless the Indemnified Persons from any and all expenses incurred, Claims made, or liabilities assessed against them, including but not limited to attorneys’ fees and litigation expenses, arising out of or resulting from, directly or indirectly, in whole or in part, breach or failure on the part of the Registrant or any Participant to abide by any part of this Waiver, and any actions or inactions on the part of the Participant which cause injury or damage to any other person.

(8) The Registrant on behalf of each Participant acknowledges and understands that photographs, videos and other electronic media images may be taken during the course of the Camp, and hereby grants permission to all Indemnified Persons to use the Participant’s name, voice and images of the Participant in any photographs, videos, results, publications or any other print, videographic or electronic recording of the Camp for legitimate purposes. 

(9) The Registrant in making these entries and who enters into this Waiver on behalf of a minor Participant hereby acknowledges that he or she has the legal capacity and authority to act on behalf of the Participant to legally bind the Participant on the terms set out in this Waiver.  The Registrant who enters into this Waiver on behalf of a minor Participant agrees to indemnify and hold harmless the Indemnified Persons for any expenses incurred, Claims made, or liabilities assessed against them, as a result of any insufficiency of legal capacity or authority to act on behalf of the Participant in the execution of this Waiver. 

(10) This Waiver Agreement shall be governed by and construed in accordance with the laws of Bermuda. The courts of Bermuda shall have exclusive jurisdiction to settle any dispute arising out of or in connection with this Agreement and the parties agree that the courts of Bermuda are the most appropriate and convenient courts to settle any such dispute and accordingly they will not argue to the contrary.  

By submitting these entries, the Registrant acknowledges having read and agreed to this Waiver on behalf of herself/himself and each Participant entered and registered by the Registrant.
