50th Anniversary 5K – Participant Waiver, Assumption of Risk, Release of Liability, and Indemnity Agreement
In consideration of being permitted to participate in the WUNC 50th Anniversary 5K (the “event”) I, the participant, intending to be legally bound and to the fullest extent permitted by law do hereby waive and release any and all rights and claims, demands and actions in any form whatsoever that I may have against WUNC Public Radio, LLC (the “Event Director”) and/or RunSignup.com, including all of the foregoing parties’ officers and directors, agents assisting with the event, event sponsors and their representatives, event volunteers and employees, and all other persons or entities acting on behalf of the foregoing parties (Event Director, Runsignup.com and all the foregoing, collectively, the “Event Facilitators”) for any and all losses, including but not limited to personal or property damage or injury, that might arise from or be otherwise related to my participation in this event. This release includes a covenant not to sue and encompasses all injuries and damages, including but not limited to death, suffered by me or my property before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assigns.
I know that running a road race is a potentially hazardous activity. I should not and will not enter and run unless I am medically able to do so and properly trained. I accept full responsibility for and voluntarily assume all risks associated with running in this event including, but not limited to: falls, cuts, breaks, bites, allergic reactions, strains, contact with and close proximity to other participants, vehicles or objects, the effects of weather, traffic, course conditions, and actions or negligence of other participants or third parties, and waive any and all claims which I might have based on any of those and other risks, known or unknown, attendant to running a road race. I acknowledge all such risks are understood by me and I understand it is my sole responsibility to withdraw from the event if conditions become unsafe. I agree to abide by all decisions of the Event Director relative to my ability to safely participate in or complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit, mentally capable and sufficiently trained for the completion of this event and that a licensed medical doctor has verified my physical condition.
In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to seek emergency assistance, including but not limited to calling 911, and to secure from any accredited hospital, clinic and/or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment for any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization and I release the Event Facilitators from liability related to medical decisions or care rendered in good faith.
As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of diseases, including but not limited to COVID-19, and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 or other disease distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.
I agree to indemnify, defend, and hold harmless the Event Facilitators from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to my participation in the Event, including claims by third parties.
I grant permission to all the Event Facilitators to use my name, voice and images, including but not limited to video, of myself in perpetuity and in any and all media now known or hereafter devised, including but not limited to photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event without any additional consideration, and I expressly release the Event Facilitators for any claim that may arise by such use into perpetuity.
All entry fees are non-refundable. The Event Facilitators reserve the right to postpone or cancel the event due to circumstances beyond control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under such circumstances. The Event Facilitators reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are nontransferable. I understand and agree to comply with all Event rules and regulations, including that all determinations regarding eligibility, including disqualification, shall be subject to the sole and final discretion of the Event Director.
By submitting this entry, I acknowledge having read and agreed to the above release and waiver including the no refund policy. If the participant is under 18, by submitting this entry I further acknowledge and certify that I am the parent or legal guardian, have read and understand this Agreement, consent to the minor’s participation, and agree to all terms on the minor’s behalf and my own behalf. I release and indemnify the Event Facilitators as set forth above with respect to the minor’s participation.
