In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all right and claims for damages or injuries that I may have against the Event Director, RunSignUp.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.
I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typical found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.
In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.
For and in consideration of the undersigned Athlete being allowed to attend and participate in the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck on Saturday, September 2, 2023, the undersigned athlete acknowledges and agree as follows:
The risk to have contact with individuals, who have been exposed to and/or have been diagnosed with one or more communicable diseases, including but not limited to the novel Coronavirus Disease 2019 (hereinafter “COVID-19”) or other medical conditions, diseases, or maladies does exist, and, despite the good faith implementation of recommended health, hygiene, and social distancing best practices, it is impossible to eliminate the risk that the athlete might be exposed to and/or become infected through contact with or close proximity with an individual with a communicable disease. Risk from contracting such communicable disease might include illness, permanent disability, or death.
COVID-19 is a new disease and there is limited information regarding risk factors for severe disease. Based on currently available information and clinical expertise, older adults and people of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. Based on Center for Disease Control (hereinafter “CDC”) guidance, those at high-risk for severe illness from COVID-19 are: people 65 years and older; people who live in a nursing home or long-term facility.
Those at severe risk also include people of all ages with underlying medical conditions, particularly if not well controlled, including, but not limited to: chronic lung disease or moderate to severe asthma; serious heart conditions; those who are immunocompromised (many conditions can cause a person to be immunocompromised, including cancer treatment, smoking, bone marrow or organ transplantation, immune deficiencies, poorly controlled HIV or AIDS, and prolonged use of corticosteroids and other immune weakening medications); severe obesity (body mass index [BMI] of 40 or higher); diabetes; chronic kidney disease undergoing dialysis; and, liver disease.
By signing below the undersigned acknowledges that athlete does not have an underlying medical condition, as referenced herein, or that if athlete has such underlying medical condition that the undersigned will first obtain permission from their licensed healthcare professional prior to athlete attending or participating in the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck.
People with COVID-19 have had a wide range of symptoms reported – ranging from mild symptoms to severe illness. Symptoms may appear 2-14 days after exposure to the virus. People with these symptoms may have COVID-19: cough; shortness of breath or difficulty breathing; fever of 100.3 degrees Fahrenheit or above; chills; muscle pain; sore throat; new loss of taste or smell. This list is not all possible symptoms. Other less common symptoms have been reported, including gastrointestinal symptoms like nausea, vomiting, or diarrhea.
Athlete will not attend the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck if athlete currently has symptoms or have been in contact with anyone with a confirmed COVID-19 diagnosis in the last 14 days.
If athlete has been diagnosed with COVID-19, athlete will not attend or participate in the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck.
Athlete will not attend or participate in the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck if athlete is subject to state or federal government directed quarantine or isolation.
The Race Directors retain the right to deny Athlete’s participation in the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck if the Race Directors determine, in their sole discretion, that such attendance or participation is an undue health risk to athlete or others. The Race Directors similarly have the right to deny any other individual from attending the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck if said individual’s attendance poses an undue health risk to that individual or others.
THE UNDERSIGNED KNOWINGLY AND FREELY ASSUMES ALL SUCH RISKS for Athlete’s attendance or participation in the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck .
The undersigned agrees that the undersigned and Athlete will comply with any safety or health related rules, terms, or conditions for participation in the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck.
After fully and carefully considering all of the potential risks involved, I hereby assume the same and agree to release and hold harmless, the Race Director, the Crisfield Area Chamber of Commerce, Inc., the National Hard Crab Derby, their officers, members, volunteers, agents, employees and independent contractors from any against all claims for injuries or harm arising from the Athlete’s participation in the 2023 Mike Sterling 10k Run, 5k Walk, 10k Ruck, but not limited to exposure to disease-causing organisms and objects, including, but not limited to the novel coronavirus.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver.
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
Walkers only: If the undersigned registrant is registered for the 5kwalk, the registrant agrees as follows:
- I agree and understand that no running is permitted in the 5k walk. I agree and acknowledge that any 5k participant who runs shall be disqualified.
- I agree to walk during the entire 5k walk.
- I understand that "walking is a progression of steps so taken that the walker makes contact with the ground so that no visible (to the human eye) loss of contact occurs. The advancing leg must be straightened (i.e., not bent at the knee) from the moment of first contact with the ground until the leg is in the vertical upright position." I acknowledge that this definition is taken from Rule 232(2) of the USA Track and Field Competition Rules.
- I agree to read and to familiarize myself with the rules of Race Walking before participating in the race.
- I understand that the decision of judges or the race directors to caution me or to disqualify me is final. I understand that any argument with judges or the race director shall itself be grounds for disqualification.
- I agree that, if i am disqualified during the 5k walk, i will immediately surrender my bib to the judge or official displaying to me a red card. If i surrender my bib, i will be permitted to continue the 5k walk, but i will be ineligible for any awards and i will receive a DNF.
